This week, the Central Bank of Ireland issued a guidance dedicated to the closed-ended QAIFs in relation to the share class features.

Yesterday, the Joint Committee of the European Supervisory Authorities published the Final Report to the European Commission on the draft Regulatory Technical Standards (RTS) detailing the content, methodologies and presentation of disclosures under SFDR.

The draft proposes to the Commission to apply the Level 2 provisions as from 1 January 2022, therefore the job done to comply with Level 1 by 10 of March will not be totally lost but will need a rework to fully comply with them. Be aware that this text still needs to be approved by the Commission and endorsed by the European Parliament.

Yesterday, the EIOPA Board of Supervisors approved the draft RTS PRIIPs at the qualified majority voting.

The Central Bank has jointly published a Guidance Note sets out the Central Bank’s requirements for firms seeking authorisation as a Depository of Assets other than Financial Instruments (DAoFI).

On 1st of February 2021, ESMA published its Final Report on Draft implementing technical standards under the Regulation on cross border distribution of funds.
This report proposes the templates and relevant procedures to be used or applied once the Regulation (EU) 2019/1156 of 20 June 2019 on facilitating cross-border distribution of collective investment undertakings will be applicable. The European Commission must still endorse these technical standards before they become enforceable.

Friday 29 January 2021, ESMA published a consultation on Guidelines on certain aspects of the MiFID II appropriateness and execution-only requirements.

The online consultation will last until 29 April 2021 and the final report and guidelines may be expected by Q3 2021.

Yesterday, ESMA published a communiqué informing that it is launching a Common Supervisory Action (CSA) with National Competent Authorities (NCAs) on the application of MiFID II product governance rules across the European Union. This action will be conducted during this year

The Law of 22nd January 2021 amending the amended law of 5th April 1993 relating to the financial sector and the law of 6th April 2013 relating to dematerialised securities has been published in Mémorial A of 22nd January 2021.
